1. Acceptance of Terms
By accessing or using AlertVolt's services, website, or applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. AlertVolt, Inc. ("AlertVolt," "we," "us," or "our") reserves the right to modify these Terms at any time.
2. Service Description
AlertVolt provides a developer alerting platform that delivers notifications about system incidents, errors, and events through multiple channels including SMS, email, webhooks, and third-party integrations. The Service includes:
- Real-time alert delivery via SMS and other channels
- Incident management and escalation
- Alert acknowledgement and tracking
- Audit logs and reporting
- API access for integration with your systems
3. Account Registration and Security
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access or security breach
- Accept responsibility for all activities that occur under your account
You must be at least 18 years old to use the Service.
4. SMS Terms and Conditions
4.1 SMS Consent
By providing your phone number and opting in to receive SMS alerts, you expressly consent to receive automated text messages from AlertVolt at the phone number you provided. This consent is not a condition of purchase.
4.2 Message Frequency
Message frequency varies based on your alert configuration and system activity. You may receive multiple messages per day during active incidents.
4.3 Message and Data Rates
Message and data rates may apply as determined by your mobile carrier. AlertVolt is not responsible for any charges incurred from your mobile carrier.
4.4 Opt-Out and Help
You may opt out of SMS alerts at any time by:
- Replying STOP to any SMS message from AlertVolt
- Updating your notification preferences in your account settings
- Contacting support at support@alertvolt.com
For help, reply HELP to any message or contact support@alertvolt.com.
4.5 Carrier Liability
AlertVolt is not liable for delayed or undelivered messages. Carriers are not liable for delayed or undelivered messages. SMS delivery depends on your mobile carrier's network and is subject to carrier limitations.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Transmit any malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers
- Use the Service to send spam or unsolicited messages
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove or alter any proprietary notices or labels
- Use the Service in a manner that exceeds reasonable request volume
6. User Responsibilities
You are responsible for:
- All content and data you submit to the Service
- Ensuring you have the right to send alerts to phone numbers you configure
- Compliance with all applicable laws and regulations
- Maintaining appropriate security for your systems and API keys
- Configuring alert thresholds and escalation policies appropriately
7. Payment and Billing
If you subscribe to a paid plan:
- You agree to pay all fees associated with your subscription
- Fees are billed in advance on a recurring basis (monthly or annually)
- All fees are non-refundable except as required by law
- We may change our fees with 30 days' notice
- Failure to pay may result in suspension or termination of your account
8. Intellectual Property
The Service and its original content, features, and functionality are owned by AlertVolt and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain all rights to the data and content you submit to the Service. By using the Service, you grant AlertVolt a license to use, store, and process your data solely to provide the Service.
9. Service Availability and Support
While we strive to provide reliable service:
- The Service is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free service
- We may modify, suspend, or discontinue the Service at any time
- Scheduled maintenance will be communicated in advance when possible
- Support is provided according to your subscription plan
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- ALERTVOLT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR OTHER INTANGIBLE LOSSES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO ALERTVOLT IN THE 12 MONTHS PRECEDING THE CLAIM
- SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU
11. Indemnification
You agree to indemnify, defend, and hold harmless AlertVolt, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
Either party may terminate your account:
- You may cancel your account at any time through your account settings
- We may suspend or terminate your account for violation of these Terms
- We may terminate your account with 30 days' notice for any reason
- Upon termination, your right to use the Service immediately ceases
- We will retain your data according to our Privacy Policy and legal obligations
13. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.
14. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive relief in court for intellectual property infringement.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
16. Miscellaneous
Entire Agreement: These Terms constitute the entire agreement between you and AlertVolt regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
